Please help, need info for warranty fix

ok so on 5/24/08 i went and bought and 05 wrx with 46k miles on it, it ran good for the whole 5 days i had it, well that thursday i was going on a date and it broke down, starting knocking/rattling horribly bad, right when i pulled off the highway the steering was stiff so i know the power steering was off so the engine cut out.. i was in an unsafe place so i tried to start it a few times to maybe get off the busy exit for the highway. they have had the car since that thursday, finally got permission to tear it apart found a spun bearing from what im told. Well now they manufacturer warranty is denying it because of "abuse" at first they said previous owner, well today they tell my mom a diffrent story that its my fault. i have an extended warranty to, and now they are saying it wont cover it ### of my abuse. i had the car for 5 days i did not drive it hard, i got into it here and there, but hell the salesman drove it harder than i did on the test drive. one thing i know these cars have problem with is the oil burning, and sometimes use that as their lil pwn off excuse. well can anyone PLEASE help me and give me info about how i couldnt of done this in 5 days actually 4 full days and barely a half of 2 days... im getting really pissed now ### they were telling me everything is ok that they were puttin a new short block in as soon as they get approval now the story has changed.. ### HELP!!

I don't see how previous abuse is not covered by the warranty. It covers the current condition of the car when you bought it so even if they claim abuse, they'd have to prove it was not existing abuse. I can't see their side holding up in court. I'd imagine if you threaten hard enough they'll cave. Get a lawyer, that's usually all the indication they need that you're serious.

As for getting your money back for the car, that's usually only within the first three days.

Three day right to rescind I don't even think is federal, it's just the most common state law. Maybe your state is different than mine. Three days is the most common though.

Also they'll count the time it was under the knife as well so even a week has come and gone. Point is it's your car.

yes they are refusing to let me give it back.. they are giving me all sorts of crap.. they didnt contact my extended warranty company, and now that they did they told me a whole nother BS lie about how it doesnt go into effect untill my manufacturer warranty goes out, which is bs ### since they denied my claim my manufacturer is void now.. im so pissed off they keep telling me this and that, im affraid my last restort has come and thats getting a lawyer.. now they are saying a subaru rep would pay 1/2 of it under the circumstances and they are trying to get the owner to pay 1/2.. i can not belive the crap i am getting for buying one of my longed dream cars.... this is rediculous.. thanks for the input sorry didnt get back sooner internet has had problems

Ask them what kind of abuse would cause the damage in 5 days. When they can't explain that, ask them to prove it was you that caused the problem. If they can't but still won't warranty the car, call the lawyer while you are standing there. They'll probably start stammering and offering you all kinds of stuff.

Btw, did you buy this from a Subaru dealer? If so, contact Subaru of America. They may be able help your case.

when will subaru stop being POS's. we all love subaru but that crap pisses me off when they refuse to pay for the shit that's owed to us. simple as dont take no for an answer, make a huge scene, trust me it will work. say you wanna talk to the manager and say you wont leave till you talk to him and get your way. and yell and curse and bring all the attention to you take some stuff you could throw like a used phone and throw it and break it, let them know your pissed.


you know when kids pout and kick and throw things till they get their way? this is the same way. ive had to do the same thing with a tire company, but that's what it takes to get your way. TRY IT!!!!

so happy ending to the bs, i mean considering the situation.. subaru only payed 1/2 still but the dealer covered other 1/2 and my warranty remains(like i care about that see where it got me before) brand new short block, and every maintenance done, filters, fluids etc.. so i finally got it back about 4 days ago everything seems to be running great.. even though yes i am taking it easy and breaking it in, so have yet to get into.. im just thankful its finally over screw that dealership and subaru for puttng me threw that for a month
