4th gear whine

I just bought a WRX 3 weeks ago, sitting in traffic last week and came to a stop, some ass wasn't paying attention and slams into a car that slams into me then throws me into a car in front of me. No real damage other than the front and rear bumper needed to be replaced, mostly paint damage. Anyway after the cops show up and write up everything I go to continue the rest of the way to work, whenever I shift into 4th gear (while moving) it makes this whiny, grinding noise, I hear it start to fade as I decelerate.....

I only hear the noise when I shift from 3rd to 4th and I push the shifter all the way back to the stopping point. Once I let up the noise goes away but if you pull on the shifter while it's in 4th slightly you can hear the noise again.

It sounds like it's coming from the shifter itself, so I'm not sure if it's a tranny issue or something else, frankly I haven't had the car long enough to really know anything about it. Anyone have any ideas what it could be or what to look for?

I went out and took a small video (3mb) of the noise. Listen carefully when you see me shift into 4th:

wow, that is weird. I know you are not supposed to give an answer that is a guess... my guess is that its a 4th gear syncro going bad.

yea that's what I was thinking to, but I took it to a trans shop and the guy that looked at it said he doesn't think that's what it is. I forgot to mention that this only happens when I have the clutch pressed......if I pull on it like that in 4th gear while the clutch is engaged it doesn't make that noise, but when the clutch is pressed it does. He told me because the clutch is disengaged when the noise occures he didn't think it was a syncro, he said he never heard anything like it before heh.

I'm basically fighting with the insurance company about it, they told me if they tear it down and can't prove that the damage is a result of the accident and not "wear and tear" that I'll have to foot the bill, which I don't have ..... last time I checked transmission internals don't "wear and tear" it's either broke or it's not...
